SUMMARY OF ORDINANCE NO. 2020-12 AN ORDINANCE OF THE CITY OF NEVADA CITY AMENDING PORTIONS OF CHAPTER 13.20 OF THE NEVADA CITY MUNICIPAL CODE PERTAINING TO FLOOD PLAIN MANAGEMENT TO COMPLY WITH FEMA'S REQUIREMENTS The Ordinance amends portions of Chapter 13.20 of the Nevada City Municipal Code entitled "Flood Plain Management" to comply with updated Federal Emergency Management Agency's ("FEMA") regulations of flood plains. The Ordinance updates definitions in Section 13.20.020 of the Chapter and amends the General Provision Section 13.20.030 to refer to specific flood plain maps used by FEMA as the basis for establishes the City's areas of special flood hazard. The Ordinance also updates the duties and responsibility of the City's Floodplain administrator in Section 13.20.40 of the Chapter to require the Floodplain administrator to notify FEMA of changes in the base flood elevation by submitting technical or scientific data (so insurance and floodplain management can be based on current data) within 6 months of discovery of any such change. The Ordinance also amends Section 13.20.050 of the Chapter entitled "Provisions for flood hazard reduction" to provide updated building elevation requirements for flood-proofing and updated building requirements for new construction or substantial improvements. The Ordinance was approved by a 4-0 vote of the City Councilmembers (with one vacant Councilmember seat), and will take effect thirty (30) days after its adoption.
