The Ordinance amended portions of Sections 17.72.026, and 17.72.027, to allow for the construction of up to two (2) of either of the following types of units on lots with existing multi-family residential dwellings: a detached accessory dwelling unit or a new construction attached unit that adds square footage to the footprint of an existing building may be constructed, provided that such unit shall not exceed sixteen (16) feet in height, and must have a minimum of four-foot side and rear yard setbacks. If such a unit complies with standard setbacks of the zoning designation, then a newly constructed unit may be constructed over an existing, permitted garage or carport, not to exceed twenty-five feet (25') in height. The maximum square footage of detached accessory dwelling units on lots with existing multi-family residential dwellings shall comply with the limits set forth in Section 17.72.024 of the Nevada City Municipal Code. The Ordinance also added language to clarify that Section 17.72.026, subdivision (F), pertaining to owner-occupancy limitations, does not apply to multi-family lots which are not expected to have owner-occupied units now or in the future. The Ordinance was approved by a 4-0 vote of the City Councilmembers (with one vacant Councilmember seat), and will take effect thirty (30) days after its adoption.
