SUMMARY OF ORDINANCE NO. 2020-11 AN ORDINANCE OF THE CITY OF NEVADA CITY REPEALING AND REENACTING CHAPTER 13.08 OF THE NEVADA CITY MUNICIPAL CODE REGULATING THE CITY'S SEWER SYSTEM The Ordinance repeals and reenacts Chapter 13.08 of the Nevada City Municipal Code entitled "Sewer System" which regulates discharges into the city sewer system, requires a discharge permit, and/or requires pretreatment of certain waste products before they may be discharged into the City's sewer system. The Ordinance requires landowners of properties with connections to city sewer lateral line to bear all costs and expenses with respect to sewer lateral lines, including without limitation, installation, maintenance and repair. The Ordinance prohibits the discharges of certain substances into the City's sewer system, and enables the City to reject such discharges, require the pretreatment of these substances, limit the quantities of the discharges of the substances, require testing of the discharges, and/or impose additional fees for the discharge of these substances. The Ordinance also requires sewer users who meet the ordinance's criteria to obtain an industrial waste water permit, and to follow the ordinance's regulations of discharges under these permits and to pay associated permit fees. The Ordinance provides specific regulations on the food service establishments for the for the discharge of fat, oils, and greases. The ordinance also provides an appeal process for permit issuance and other decisions made by the City under the ordinance. The Ordinance was approved by a 4-0 vote of the City Councilmembers (with one vacant Councilmember seat), and will take effect thirty (30) days after its adoption.
