NEVADA COUNTY PLANNING COMMISSION REGULAR MEETING NOTICE OF PUBLIC HEARING Notice is hereby given that on Thursday, July 23, at 1:30 p.m. or as soon thereafter as the matter may be heard, in the Supervisors' Chambers, First Floor, Eric Rood Administrative Center, 950 Maidu Avenue, Nevada City, California, the Nevada County Planning Commission will hold a public hearing for the following projects: 1:30 p.m. PROJECT DESCRIPTION: The proposed project is an Area Plan for the Penn Valley area, with land use regulations focused on the Penn Valley Village Center as established by the County General Plan, but also extending to the surrounding area to assist in establishing a connection from Penn Valley to Lake Wildwood. The project builds upon and overhauls the existing 2000 Penn Valley Area Plan as a comprehensive Area Plan that is more than just an update to the prior planning policy document. The 2020 Penn Valley Area Plan (Area Plan) is a focused policy and design document that supplements the Nevada County General Plan and Zoning Ordinance. It serves as the comprehensive land use and zoning plan for the community of Penn Valley and embodies the expressed goals of residents and business owners to help shape the future of their community. The Penn Valley Area Plan is comprised of the following plan components and discretionary actions: General Plan Text Amendment: To adopt the Area Plan. General Plan Land Use Map Amendment: o APN: 051-220-015. (7.11-acres). Western Gateway Park property from Residential (RES) to Recreation (REC). Zoning Map Amendment: Parcel rezoning to correspond with the proposed expansion of the Area Plan boundaries to add the Site Performance (SP) Combining District zoning to specific parcels to reflect the applicability of the Area Plan (See Appendix B of the Draft Initial Study/Negative Declaration), and site-specific rezoning as follows: o APN: 051-220-015. (7.11-acres). Western Gateway Park property from Residential Agricultural -1.5 (RES/RA-1.5) to Recreation (REC). o APN: 051-120-005 and 051-120-013. (1.23 and 0.52-acres). Nevada County Cemetery District properties from RA-1.5 to Public (P). Site already has a Public (PUB) General Plan Land Use designation. Zoning Ordinance Amendment: Amending Sec. L-II 4.2.3 of the Nevada County Zoning Ordinance to add a reference to the proposed Penn Valley Area Plan design guidelines and standards. RECOMMENDED ENVIRONMENTAL DETERMINATION: Approve the Negative Declaration (EIS20-0007) RECOMMENDED PROJECT ACTION: Approve the proposed General Pl an Amendment (GPA20-0001), General Plan Text Amendment (GPT20-0001), Rezone (RZN20-0004) and Ordinance (ORD20-3). PLANNER: Tyler Barrington, Principal Planner The public meeting will be held at the Eric Rood Administration Center Board of Supervisor Chambers, located at 950 Maidu Avenue, Nevada City, unless Governor Newsom's Executive Order pertaining to the COVID-19 pandemic and/or the social distancing guidelines as outlined by the Nevada County Public Health Department are still in effect at that time. In the case of ongoing social distancing, the Board Chambers will remain closed to the public as they are currently. The Planning Commission will attend the meeting and participate remotely to the same extent as if they were present. If social distancing measures are no longer in effect and the meeting occurs in the Board Chambers, any person wishing to offer testimony on this matter should appear at the public hearing or may submit written comments (an original and 8 copies) to the Clerk of the Planning Commission in advance of the meeting. If social distancing measures are in effect and the meeting occurs online, members of the public may still provide live public comment during the hearing, and may submit written comments on this matter by email, U.S. Mail, or through our eComment system at http://nevco.granicus.com/ViewPublisher.php?view_id=19 throughout the meeting. In order for comments to be entered into the administrative record of the meeting, they must be received no later than 10:00 a.m. on the morning of the noticed meeting. You have the right to attend the Planning Commission meeting and public hearing to provide oral testimony and comment, and/or to submit written materials regarding the potential actions. The Planning Commission Chair may place reasonable restrictions on the time allowed to any person to speak on these matters. Any person speaking on behalf of an organization or group who wishes additional time must have a written statement signed by an officer of that organization stating that she/he is authorized to speak on behalf of that body, and that she/he is relaying the majority thinking thereof. If you challenge the Planning Commission's determinations or decisions in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at or prior to the public hearing.
